Kullanım Şartları

Bu şartlar FishMaps uygulamasını kullanman için geçerlidir. Hesap açarak veya uygulamayı kullanarak bu şartları ve Gizlilik Politikası'nı kabul etmiş olursun. İletişim: fishmapss@gmail.com

1. Hizmet

FishMaps; harita, mera, hava ve deniz tahmini, av günlüğü, topluluk paylaşımı ve telsiz özellikleri sunan bir balıkçılık yardımcısıdır. Hizmeti FishMaps adıyla Enes Seyit (gerçek kişi, Bursa, Türkiye) sunar.

2. Hesap

Hesap açmak için en az 13 yaşında olmalısın. Bulunduğun ülkede reşit değilsen satın alma için veli izni gerekir.
Doğru bilgi vermek, şifreni gizli tutmak ve hesabındaki işlemlerden sorumlu olmak sana aittir.
Başkası adına veya başkasını taklit eden hesap açamazsın. Hesabını istediğin an uygulamadan silebilirsin.

3. Bilgiler ve güvenlik

Hava, deniz, mera, av yasağı, asgari boy ve tür bilgileri yalnızca bilgilendirme amaçlıdır; doğruluğu garanti edilmez ve resmî düzenlemelerin yerine geçmez. Bölgendeki güncel avcılık kurallarına uymak senin sorumluluğundur.
Denizde ve kıyıda güvenliğin senin sorumluluğundadır. Hava koşullarını resmî kaynaklardan da kontrol et.
SOS özelliği yalnızca yakındaki FishMaps üyelerine haber verir; acil servislerin yerine geçmez. Acil durumda 112'yi (Türkiye'de Sahil Güvenlik için 158'i) ara.

4. Topluluk kuralları ve içerik

Paylaştığın içerikten (fotoğraf, yazı, ses, konum) sen sorumlusun. Paylaşmaya hakkın olmayan içeriği yükleme.
Yasak: küfür, hakaret, taciz, tehdit, nefret söylemi, müstehcen içerik, spam, dolandırıcılık, başkalarının kişisel verilerini paylaşma, telif ihlali ve yasa dışı avcılığı (yasak tür, sezon, boy veya yöntem) teşvik etme.
Kurala aykırı içeriği uygulamadaki "Rapor et" düğmesiyle veya fishmapss@gmail.com adresine yazarak bildirebilirsin. Farklı üyelerden gelen şikayetler otomatik olarak uyarı ve uzaklaştırmaya (1 gün, 3 gün, askıya alma) yol açabilir. Yöneticiler kurala aykırı içeriği kaldırabilir, hesabı kısıtlayabilir veya kapatabilir. Premium üyelik bu kararları kaldırmaz.

Telsiz: bas-konuş ses kayıtları ve mesajlar odadaki herkese açıktır ve 24 saat sonra silinir. Başkalarının sesini izinsiz kaydedip yayma. SOS özelliği resmi acil yardım hatlarının (112, 158 Sahil Güvenlik) yerine geçmez.
Bildirimler: izin verirsen arkadaş, grup, telsiz, güvenlik ve hesap bildirimleri gönderilir; cihaz ayarlarından kapatabilirsin.
İçeriğin sende kalır. Hizmeti sunmak için içeriğini saklamamız, göstermemiz ve gerekli teknik kopyalarını oluşturmamız için bize ücretsiz, münhasır olmayan bir izin verirsin. Bu izin içeriği veya hesabını sildiğinde sona erer.

5. Abonelikler ve bölge paketleri

Premium ve bölge paketleri (bölge abonelikleri) uygulama mağazası (Google Play; ileride App Store) üzerinden satın alınır ve ödeme mağaza hesabından alınır. Bölge paketi o bölgenin içeriğini ve odalarını açar ve temel premium özelliklerini de içerir.
Abonelikler seçtiğin döneme göre (aylık veya yıllık) otomatik yenilenir. Dönem bitmeden iptal etmezsen bir sonraki dönem ücreti tahsil edilir. Ücretsiz deneme sunulursa, deneme bitmeden iptal etmediğinde ücretli abonelik başlar.
İstediğin an Google Play → Ödemeler ve abonelikler → Abonelikler bölümünden iptal edebilirsin (https://play.google.com/store/account/subscriptions?package=com.fishmaps.app). İptal, mevcut dönemin sonunda geçerli olur; o zamana kadar erişimin sürer.
Fiyatlar satın almadan önce mağazada gösterilir. İadeler Google Play iade politikasına tabidir. Tüketici olarak yasal hakların saklıdır.
Uygulamayı kaldırmak veya hesabını silmek aboneliği iptal etmez.

6. Firma hesapları ve sponsorlu içerik

Firmalar uygulamadaki "Sponsor ol" formuyla başvurur. Başvuru bir teklif değildir; paket, süre ve ücret FishMaps ile firma arasında uygulama dışında anlaşılır. Uygulama içinde ödeme alınmaz.
Onaylanan firma hesabı doğrulanmış rozet alır. Firma; profil, ürün, kampanya ve indirim kodlarını yönetir; yeni ve değişen içerik yayından önce yönetici onayından geçer.
Sponsorlu içerik "Sponsorlu" etiketiyle gösterilir (vitrin, ana sayfa, mera kartı, bölge). Yerleşim ve süreler anlaşmaya göredir; süre bitince otomatik yayından kalkar. FishMaps kurallara aykırılıkta sponsorluğu duraklatabilir veya durdurabilir.
Firma; ürün, fiyat, kampanya ve indirim kodlarının doğruluğundan, mevzuata (tüketici, reklam, su ürünleri avcılığı) uygunluğundan ve müşterileriyle yaptığı satışlardan tek başına sorumludur. FishMaps firma ile üyeler arasındaki satışın tarafı değildir.
Firma, verdiği iletişim bilgilerinin (telefon, WhatsApp, web) üyelerin kendisine ulaşması için gösterilmesini kabul eder.

7. Fikri mülkiyet

Uygulama, tasarım, marka ve içerikler (üyelerin içerikleri hariç) FishMaps'e veya lisans verenlere aittir. Harita verileri © Mapbox ve © OpenStreetMap katkıcılarıdır. Uygulamayı tersine mühendislik, kazıma (scraping) veya otomatik erişim için kullanamazsın.

8. Sorumluluğun sınırı

Uygulama "olduğu gibi" sunulur; kesintisiz veya hatasız çalışacağını garanti etmeyiz. Kanunun izin verdiği ölçüde, uygulamadaki bilgilere dayanarak verilen kararlardan, kayıp av, ekipman, kaza veya dolaylı zararlardan sorumlu değiliz. Kasıt, ağır ihmal ve vazgeçilemeyen tüketici hakları bu sınırlamanın dışındadır.

9. Sona erme

Hesabını istediğin an silebilirsin. Bu şartları ciddi veya tekrar eden şekilde ihlal edersen hesabını askıya alabilir veya kapatabiliriz.

10. Değişiklikler ve uygulanacak hukuk

Şartları güncelleyebiliriz; önemli değişiklikleri uygulamada duyururuz. Değişiklikten sonra kullanmaya devam etmen yeni şartları kabul ettiğin anlamına gelir. Bu şartlara Türkiye Cumhuriyeti hukuku uygulanır; yaşadığın ülkenin tüketiciyi koruyan zorunlu hükümleri saklıdır.

These terms apply to your use of the FishMaps app. By creating an account or using the app you accept these terms and the Privacy Policy. Contact: fishmapss@gmail.com

1. The service

FishMaps is a fishing companion with a map, spots, weather and marine forecasts, a catch log, community sharing and a radio. The service is provided under the FishMaps name by Enes Seyit (individual, Bursa, Türkiye).

2. Your account

You must be at least 13 to create an account. If you are a minor in your country, purchases need a parent's permission.
You are responsible for giving accurate information, keeping your password secret and for activity on your account.
You may not create an account for or impersonate someone else. You can delete your account in the app at any time.

3. Information and safety

Weather, marine, spot, closed season, minimum size and species information is for guidance only; it is not guaranteed to be accurate and does not replace official regulations. Following the current fishing rules where you fish is your responsibility.
You are responsible for your own safety at sea and on the shore. Check conditions with official sources too.
The SOS feature only alerts nearby FishMaps members; it does not replace emergency services. In an emergency call 112 (or your local emergency / coast guard number).

4. Community rules and content

You are responsible for what you share (photos, text, voice, location). Do not upload content you have no right to share.
Not allowed: swearing, insults, harassment, threats, hate speech, sexual content, spam, scams, sharing other people's personal data, copyright infringement and promoting illegal fishing (protected species, closed seasons, undersized fish or banned methods).
You can report content that breaks the rules with the "Report" button in the app or by writing to fishmapss@gmail.com. Reports from different members can automatically lead to a warning and suspensions (1 day, 3 days, indefinite). Admins may remove content that breaks the rules and restrict or close accounts. Premium does not override these decisions.
To appeal a decision, write to fishmapss@gmail.com.
Radio: push-to-talk recordings and messages are visible to everyone in the room and deleted after 24 hours. Do not record or redistribute other people's voices without permission. The SOS feature does not replace official emergency numbers (112, coast guard).
Notifications: if you allow them, we send friend, group, radio, security and account notifications; you can turn them off in device settings.
You keep ownership of your content. You give us a free, non-exclusive permission to store, display and make the technical copies needed to provide the service. This permission ends when you delete the content or your account.

5. Subscriptions and region packs

Premium and region packs (region subscriptions) are bought through the app store (Google Play; App Store later) and charged to your store account. A region pack unlocks that region's content and rooms and includes the core premium features.
Subscriptions renew automatically for the period you chose (monthly or yearly). Unless you cancel before the period ends, the next period is charged. If a free trial is offered, the paid subscription starts unless you cancel before the trial ends.
You can cancel any time in Google Play → Payments & subscriptions → Subscriptions (https://play.google.com/store/account/subscriptions?package=com.fishmaps.app). Cancellation takes effect at the end of the current period; you keep access until then.
Prices are shown in the store before you buy. Refunds follow the Google Play refund policy. Your statutory consumer rights are not affected.
Uninstalling the app or deleting your account does not cancel a subscription.

6. Firm accounts and sponsored content

Firms apply with the in-app "Become a sponsor" form. An application is not an offer; package, period and fee are agreed between FishMaps and the firm outside the app. No payment is taken in the app.
An approved firm account gets a verified badge. The firm manages its profile, products, campaigns and discount codes; new and changed content is reviewed by an admin before it goes live.
Sponsored content is labelled "Sponsored" (showcase, home, spot card, region). Placements and periods follow the agreement and are unpublished automatically when the period ends. FishMaps may pause or stop a sponsorship that breaks these rules.
The firm alone is responsible for the accuracy and legality (consumer, advertising and fishing law) of its products, prices, campaigns and discount codes and for its sales to customers. FishMaps is not a party to sales between firms and members.
The firm agrees that the contact details it provides (phone, WhatsApp, website) are shown so members can reach it.

7. Intellectual property

The app, design, brand and content (other than members' content) belong to FishMaps or its licensors. Map data © Mapbox and © OpenStreetMap contributors. You may not reverse engineer, scrape or access the app by automated means.

8. Limitation of liability

The app is provided "as is"; we do not guarantee it will be uninterrupted or error-free. To the extent permitted by law, we are not liable for decisions made based on information in the app, lost catches or equipment, accidents or indirect damages. Intent, gross negligence and mandatory consumer rights are not limited.

9. Termination

You can delete your account at any time. We may suspend or close your account for serious or repeated breaches of these terms.

10. Changes and governing law

We may update these terms and will announce material changes in the app. Continuing to use the app after a change means you accept the new terms. These terms are governed by the laws of the Republic of Türkiye; mandatory consumer protection rules of the country you live in remain unaffected.
